Whales worth more than Sailors

Filed under: animals, court, global war, otb, Talon — Rosemary Welch @ 11:03 pm

That is the only reason I can understand the ruling of the 9th Circuit Court of Appeals. Apparently, they believe they are more apt to run a war than the Admirals themselves, and this decision proves them so vastly wrong.

Even Justice Kennedy couldn’t swallow this one:

Under the guidance of Anthony Kennedy, the Supremes have lately taken to arrogating war powers to themselves. (See here.) But even Justice Kennedy may blanch at National Resources Defense Council v. Winter. In that case, the Ninth Circuit ruled that preparing the Navy to fight in a time of war was not an “emergency,” and that our sailors must stop training lest their sonar harm . . . whales.

Just tipping you off as to what to watch for in the next round of SCOTUS decisions. There is a possibility this will never be decided, but the Supremes have decided to at least hear it. That is a step in the right direction.

This should also give us pause to consider who we vote for when we vote. I am not endorsing anyone here, I am just suggesting that we try to find out as much as we can about their policies – especially in matters such as judges – so that we may make an informed decision.

I have just one question really. If we are in a war and need to practice and train, and this is not considered an emergency; what, pray tell, is?

Homosexuals will harm the Military

Filed under: civil rights/duties, court, homo-, laws, Military, otb — Rosemary Welch @ 9:25 pm

Now that homosexuals have won in the courts in California and Massachusetts, not through the legislative process which they continually fail to win, these states have claimed they must abide by the court’s orders to ‘marry’ same-sex people. Beside this being preposterous, it has the potential to do much harm to our Military.

Number one, the people – no one else – determine which powers the judicial, the legislatures, and the governors and president may encroach upon us as predetermined as necessary to run the country. They cannot just run over us whimsy-nilly anyway they desire, and the courts are about to reach the precipice. Now they are demanding we allow the minority rule (3%) over the majority? Since when when?

How does this harm the our Mililtary? If a person joins the Military as a single man or woman, then they ‘marry’ someone of the same sex but does not tell anyone (don’t ask, don’t tell), won’t the Military be obligated to pay for this person’s spouse? What if they adopt a child? Won’t we have to give them child allowances? What about divorces? Who gets custody? What if the spouse goes into the hospital? Won’t they get leave to visit?

After this goes on for a while, do you really believe that – even though they are less than 3 percent of the population – they demand equal treatment under the LAW? WHAT LAW??? See, this is where the problem arises.

In the year 2000 in California, voters sent a huge message that MARRIAGE is between one man and one woman. Period. The most liberal state, yet they know that deep down it is in the best interest for all children and society as a whole that marriage was, is, and always will be the best foundation for American society. Our LAWS demand that MARRIAGE is between one man and one woman.

This has not been changed through the legislature nor by the voters. As a matter of fact, we already have enough signatures to have this on the ballot again in November, only this time as a Constitutional Amendment.

You would think the court would consider the trauma to the people who think they are ‘married’ but come to find out WE MEANT OUR VOTES. But no, they decided to go ahead and let them do this atrocity. I call it this an atrocity because it will surely destroy some people’s hearts to find out, once again, that the rest of America may not care what you do in private, but we are not going to let you redefine marriage.

To impose this court ruling upon our Military will only change our Military to have less and less men and more homosexuals. I cannot watch a tv program that doesn’t have a homosexual in it. Do you remember what happened with the Catholic Church scandals? Is that what you want from our Military? Or would you rather say, ‘Forget political correctness, I’d rather stay alive.’? I know what side of this issue I come down on.

I believe the Military has it right. There has to be rules of conduct and regulations on certain behaviors. Otherwise, we may lose everything and the first to be persected would be the same people who are the ones fighting so hard to make it so. It is a sad state of affairs. Just ask the people in Iran.

One more tiny little thing. What about MY rights? Am I to be scorned because I believe in God? Do my rights and beliefs not matter because somehow you disagree with me? Then go for it, I will not take you to court over it. The most I will do is pray for you. Whatever happened to live and let live? God help us all.

THIS IS MY OWN OPINION, AND IT DOES NOT REFLECT ANYONE ELSE FROM THIS SITE.

SCOTUS does not reign supreme

Filed under: Constitution, court, global war, Talon — Rosemary Welch @ 2:30 pm

Many people are upset with the Thursday, June 12, 2008, decision that would allow for first time in American history (and 500 years of Common Law history) the right to a writ of habeas corpus for our enemy while in the midst of a war. I do not care to hear your tawdry arguments about whether we are or are not in a war. It has been declared against us by these so called unlawful combatants, so the issue is mute.

In case you have forgotten, please refresh your memory. Does it appear to you that we started this war? If you still believe we started this, you are a nut and I don’t have the time, desire, or the patience to explain to you how wrong you are and why. Just go somewhere and dig yourself a hole to hide in. The rest of this post is dedicated to the vast majority of readers who actually have functioning brain.

There are many things this rogue court has done, such as making its own laws and forcing them upon a population who have no recourse, taken upon themselves to be final arbiters of Military Justice, reading into the US Constitution rights that are not there, and on and on. This has to be stopped. If it is not, we shall surely die trying to correct it.

The US Constitution states quite clearly:

Article III
Section. 1. The judicial Power of the United States shall be vested in one supreme Court, and in such inferior Courts as the Congress may from time to time ordain and establish.

From this strict reading, it is the Congress who makes the laws and allows such courts to exist that may also strip these courts of all of their powers at any time. The reason this is not done, is because we are a country of laws. It used to be we were a country UNDER GOD, but I guess they may rule that out soon, too.

So what did they do this time that has gotten my panties in a wad? This latest decision that gives jihadis the right to use the same courts as I do. I am an American citizen who cannot redress of all these illegal aliens, some are jihadis it has been reported. But this is not the only thing. The major problem I am having is with the fact that it seems like many people do not understand the threat of Political Islam and global jihad.

They cannot be separated. There are many good Muslims, but they are not true Muslims. Just ask someone who actually follows the Kor’an as they are taught to do these days. These are also considered to be kafirs. They are not the people I am talking about, and I’m getting tired of saying so. We need to have an honest discussion about what is really happening.

We have learned much since the attacks on September 11, 2001. Some of us woke up and stayed awake, others of us went back to sleep. That is problem. How can we have an honest discussion with people who do not even consider themselves to be in danger of losing their very lives?

I came across this very concise and brilliant post by Jeffrey Imm over at CounterTerrorismBlog. The title of his article is, “Don’t You Know There’s A War On?” He is more qualified and capable of writing what I want to say at this moment. It may now be Monday, 5 days after the decision, but I am still too upset at the silence, the ignorance, and the sheer wrongheadedness of it all. Here is tease:

I am sending U.S. Supreme Court Justice Anthony Kennedy a framed copy of a photograph of the remains of the World Trade Center West building after the 9/11 attacks with a note “Don’t You Know There’s A War On?“.

I hope you read this article. It may be lengthy, but it is worthwhile. Thank you, and have a nice day.

Decision to Ban Homeschoolers is Vacated!

Filed under: children, court, Family, injustice, Justice, ota, Sovereignty — Rosemary Welch @ 10:57 am

I have just learned from the Family Research Center that the 2nd District Court of Appeals has vacated the decision by the California Supremes to ban anyone and everyone who does not a California quality teachers certificate and/or belongs to one of the many unions we have out here, then your career as a teacher to your children was over! Good for you, 2nd Court of Appeals. However the fight is not yet over.

I have to wait an hour to reach the office, but the link they’ve provided is incorrect. Hey, things happen. It’s just very good to know that the whole world hasn’t gone looney!

The Court is still going to have another hearing about this issue, so please put on your prayer slippers. AND USE THEM! 😉

We must fight back for the sake of our children, our families, our communities, our states, and our sovereignty! Since when does the government own our children??? THEY MOST CERTAINLY DO NOT. They want to claim nutrality when it comes to religion? Okay, then explain to me why it’s okay to have muslims praying in school, but Christian children are not even afforded the benefit of a moment of silence? Hmm?

Here is the link to the Family Research Center: FRC. Have a great day. I will try to get that link for us. 😉

Update: Here is the link to this news article.

Court of Appeal Grants Petition for Re-hearing

On March 25, the California Court of Appeal granted a motion for rehearing in the In re Rachel L. case—the controversial decision which purported to ban all homeschooling in that state unless the parents held a teaching license qualifying them to teach in public schools.

The automatic effect of granting this motion is that the prior opinion is vacated and is no longer binding on any one, including the parties in the case.

The Court of Appeal has solicited a number of public school establishment organizations to submit amicus briefs including the California Superintendent of Public Instruction, California Department of Education, the Los Angeles Unified School District, and three California teacher unions. The court also granted permission to Sunland Christian School to file an amicus brief. The order also indicates that it will consider amicus applications from other groups.

Home School Legal Defense Association will seek permission to file such an amicus brief and will coordinate efforts with a number of organizations interesting in filing briefs to support the right of parents to homeschool their children in California.
